Can You Recover a Property Reservation Payment in Turkey?

Short answer

A payment called kapora, a reservation fee or a deposit is not automatically non-refundable. Its legal effect depends on the agreement, the recipient, the validity of the underlying transaction and why the purchase did not proceed. Special withdrawal protections may apply to a qualifying consumer purchase of prepaid housing. The payment label alone cannot establish the outcome.

Overseas buyers sometimes transfer a small amount after a video viewing, before seeing the complete contract. A later disagreement may concern a mortgage, a different apartment, finance, the seller’s authority or a change of mind. Each raises a different question. The useful starting point is to reconstruct what the parties actually agreed before the transfer.

Identify what the payment was intended to do

Separate money credited toward the purchase price from payment for an identifiable service. A sum paid to reserve a unit may have been described as an advance, a withdrawal payment, a contractual penalty or an agent’s fee. These descriptions can have different legal consequences, but a heading does not resolve an unclear or inconsistent agreement.

Article 177 of the Turkish Code of Obligations starts from the position that money given when a contract is made evidences its conclusion rather than buying an automatic right to withdraw. Unless the agreement or local custom provides otherwise, this payment is deducted from the main debt. That rule does not mean every cancelled sale produces a refund; the validity of the contract and the parties’ other obligations remain relevant.

Article 178 addresses an agreed withdrawal payment, cayma parası. Under that arrangement, the payer who withdraws leaves the payment behind, while the recipient who withdraws returns twice what was received. These consequences should not be assumed merely because a bank reference says “deposit”. A contractual penalty is a separate question and also needs examination.

Check the contract before debating the refund

The form of the intended property transaction matters. A reservation receipt, informal sales document and a formally executed promise of sale do not necessarily provide the same rights. A refund analysis should establish what contract, if any, was validly concluded and whether the payment was tied to a condition that did not occur.

Article 77 provides a restitution framework where enrichment lacks a valid legal basis, including a basis that is invalid, fails to arise or later ends. Applying that rule requires identifying the person enriched and the payments actually made. It is not a promise that the full amount can always be collected immediately, or that every person involved in advertising the property is responsible.

For example, if the written reservation says the money will be returned if a specified title restriction cannot be removed, preserve that wording and evidence of the restriction. If finance approval was never made a condition, the analysis may be different. Ask whether the disputed event was addressed in the agreement rather than relying on what one party now says was understood.

Was this a consumer prepaid housing purchase?

Specific protections apply when a seller and a consumer conclude a qualifying prepaid housing contract. The Ministry of Trade explains that the seller cannot demand payment under any name before a valid contract has been made. Whether a transaction falls within this scheme depends on the parties and the transaction, not the buyer’s language or foreign nationality.

Within that scheme, the consumer has a 14-day right to withdraw without giving a reason or paying a contractual penalty. The official guidance describes notice through a notary within the period and repayment within 14 days after the seller receives the withdrawal notice. Keep the contract date, notice and delivery evidence together.

A later right to withdraw from the transaction, described in Turkish as sözleşmeden dönme, has different conditions, possible deductions and repayment timing. Do not use the 14-day rule as a universal answer after that period, or apply it automatically to a second-hand sale between private individuals. An email headed “cancel my reservation” may also be insufficient for a route requiring a particular notice procedure.

Who received the money?

Compare the seller named in the documents with the bank-account holder and the person issuing the receipt. If an agent collected the payment, establish whether they acted for the seller, received their own fee or held money for another purpose. Obtain any collection authority or instruction. A payment to an individual account where the proposed seller is a company needs an explanation supported by documents.

The analysis should distinguish a claim against the contractual counterparty from a claim against the actual recipient. Sending a demand to the most visible person is not necessarily enough. Keep the original transfer record, currency, date and payment reference; screenshots of a balance without recipient details are less useful.

Preserve the complete transaction record

  • The reservation document, all contract drafts and any signed annexes.
  • The advertisement and the unit or parcel details that identify the intended property.
  • Bank records, receipts and payment instructions.
  • Messages about refund conditions, deadlines, finance or title restrictions.
  • Evidence of who represented the seller and was authorised to receive payment.
  • Withdrawal, default or cancellation notices and evidence of dispatch and receipt.

Keep the original message history as well as selected screenshots. A short extract can omit the condition agreed immediately before or after it. If the contract is in Turkish, obtain a reliable translation before deciding what the English word “deposit” was intended to describe.

Practical assessment

A useful refund request identifies the agreement, the payment, the reason for repayment and the person asked to repay it. It should distinguish the amount transferred from any separately claimed interest, costs or damages. The appropriate court, consumer route or preliminary mediation requirement depends on the transaction and claim; do not choose a procedure solely from the amount paid.

For a buyer abroad, the first step can usually be a document review. A representative may then need suitable authority for notices or proceedings. Before signing a settlement or a new reservation document, check whether it releases existing claims, changes the recipient’s obligations or replaces the original payment with credit toward another unit.

For questions about the payment and purchase documents, use the contact page to describe the transaction. An initial summary can state the payment date, recipient and reason the purchase stopped without sending identity documents.
