Property Inheritance
Legal questions concerning inherited property in Turkey, including matters with an international element.
A property inheritance in Turkey may involve family records, wills and proceedings in more than one country. Establishing the heirs, recording the inherited interest and deciding how the property will be managed or divided are connected but separate steps. Residence abroad does not remove the need to establish the relevant facts for the Turkish asset.
Issues that may need review
- The deceased’s property remains registered in their name and the heirs need an inheritance certificate.
- A foreign certificate, will or family record must be assessed for use in Turkey.
- Heirs disagree about sale, occupation, rental income or division of the property.
- The estate includes debts, disputed transfers or uncertainty about the deceased’s nationality and family relationships.
Documents for an initial assessment
- Death certificate and available records of the deceased’s nationality and family relationships.
- Wills, inheritance certificates, foreign court decisions and any information about their finality.
- Title details, known properties, leases, bank records and documents concerning estate debts.
- Earlier estate applications, correspondence between heirs, and any proposed division agreement.
Process and conditions that matter
The first review identifies the deceased, potential heirs, Turkish assets and any existing foreign proceeding. The applicable law, competent authority and evidence needed for a certificate are then examined. Under Turkish conflict-of-laws rules, inheritance of immovable property in Turkey is governed by Turkish law, subject to applicable treaty provisions; this should not be extended automatically to every asset abroad.
An inheritance certificate and registration do not resolve every disagreement about use or division. Where heirs cannot agree, the legal form of their ownership, the available division route and applicable pre-action mediation requirements need separate consideration. Estate debts and possible time-sensitive choices should be identified early.
If you are outside Turkey
Documents from abroad may need translation and authentication appropriate to their country and type. A foreign inheritance certificate should not be assumed to produce a direct Turkish title transfer. A suitable representative may handle authorised steps, but the required documents and any need for personal participation must be checked for the particular proceeding.
Questions and answers
Does living abroad prevent me from dealing with inherited Turkish property?
Living abroad is not, by itself, the obstacle. Heirship, acquisition restrictions, documents and the representation arrangements still have to be established.
Can a foreign applicant obtain the usual notarial inheritance certificate?
Turkish notaries cannot issue this certificate where it is requested by foreigners under the statutory restriction. The appropriate court route must be considered.
Can one heir decide to sell the whole property?
The ownership structure and other heirs’ rights must be checked. A person’s own interest in the estate should not be confused with authority to dispose of the entire property.
