Title Cancellation & Registration

Legal work concerning disputed title records and claims to ownership of property.

A title dispute asks whether the registered ownership or another registered right reflects the legally valid position. The remedy depends on the defect alleged, the chain of transfers and the current rights of other people. A claim for correction of the land register should be distinguished from a claim for payment and from correction of a simple clerical error.

Issues that may need review

  • A transfer is challenged because of a forged document, disputed authority or misuse of a power of attorney.
  • The property has passed to another buyer after the disputed transaction.
  • An inheritance, contract or co-ownership disagreement raises a competing claim to the registered right.
  • The register contains an identity discrepancy, or an ongoing dispute raises concern about a further transfer.

Documents for an initial assessment

  • Current title record and the available history of transfers, mortgages and annotations.
  • Official transaction documents, powers of attorney and the records on which registration was based.
  • Contracts, payment evidence, inheritance documents and correspondence relevant to the alleged defect.
  • Existing court decisions, their procedural status, service documents and any interim measures.

Process and conditions that matter

The first stage establishes the right claimed and the specific registration said to be defective. The evidence must address the transaction that produced the entry and, where relevant, what subsequent acquirers knew or should have known. The correct defendants and precise relief are then identified.

Turkish Civil Code provisions protect certain rights acquired in good faith through reliance on the register while allowing correction of unlawful registration. This makes the acquisition history important. If the property may be transferred again, an interim measure can be considered under its legal conditions; filing a claim should not be assumed to freeze the register automatically.

If you are outside Turkey

For a claimant abroad, reliable copies of earlier documents and a clear chronology can help identify the necessary Turkish records. Foreign signatures or powers of attorney may require records from their issuing authority. Procedural powers, translations and communication arrangements should be settled before time-sensitive steps are taken.

Questions and answers

Is every incorrect name in the register a title-cancellation lawsuit?

No. A clerical or identity correction and a dispute over ownership can require different procedures. The nature of the discrepancy must first be established.

Does a successful first-instance decision finish the matter?

Not necessarily. Available appeals, finality and implementation must be checked. An appellate reversal may require further examination rather than establish who finally owns the property.

Can I rely only on the fact that the first transfer was invalid?

Not where later rights are also involved. Their legal basis and any protected good faith must be assessed separately.

Discuss a property matter

Identify the property, the main question and any important approaching date. A passport or a complete case file is not required for the first message.
