Property Fraud

A document-led assessment when the facts of a property transaction raise concerns about deception or misuse.

An unexpected transfer, a disputed power of attorney or a payment to the wrong recipient requires a documented chronology. The immediate questions are what was authorised, what actually happened, who received the money and who now holds the registered right. Suspicion alone does not establish fraud or determine the available civil remedy.

Issues that may need review

  • A signature or power of attorney is alleged to be forged.
  • A genuine representative is said to have acted contrary to instructions or misused an authority to sell.
  • Money was paid to an intermediary whose authority to receive it is unclear.
  • The same property was promised to several buyers, or material information was concealed.

Documents for an initial assessment

  • Agreements, powers of attorney and available records identifying their issuing authority.
  • Bank transfers, receipts and the account details used for payment.
  • Original messages, emails and advertisements, with their dates and available metadata.
  • Current and earlier title records, notices, and any existing police, prosecution or court documents.

Process and conditions that matter

The review separates allegations, documents and facts established by a court. A timeline of instructions, payment and registered transfers helps identify the possible claim and the person against whom it may be directed. Original electronic material should be preserved; edited screenshots alone may leave important gaps.

The next stage considers whether the objective is recovery of title, repayment, compensation or urgent protection. Civil and criminal routes raise different questions. Starting a criminal complaint does not itself correct a title record or guarantee the recovery of money. Where a further transfer is a concern, the evidence and conditions for an interim court measure should be assessed promptly.

If you are outside Turkey

For an owner outside Turkey, the place where a disputed document was issued may matter as much as the location of the property. Authentication, translation and records from the issuing authority can help establish what the document actually says and whether it was issued. The scope of any new power of attorney should be defined for the required proceedings.

Questions and answers

Does an unpaid sale price always mean fraud?

No. Non-payment, a contractual breach, an invalid transaction and fraudulent conduct are distinct questions. The explanation depends on the documents and established facts.

Can a later buyer keep the property?

The answer may depend on the validity of the earlier transfer and the later buyer’s protected good faith. A defect in an earlier transaction is not, by itself, the full analysis.

Should a judgment mentioned in an article be treated as a guaranteed result?

No. The decisions discussed in Insights concern their own facts and procedural stages. They are not descriptions of this practice’s cases or outcomes.

Discuss a property matter

Identify the property, the main question and any important approaching date. A passport or a complete case file is not required for the first message.
