Can You Use a Power of Attorney Signed Abroad for Property in Turkey?

Short answer

A power of attorney signed abroad can be used for a Turkish property transaction if its form, authentication, translation and powers meet the requirements of that transaction. An apostille alone does not establish that the representative may sell a property, receive money or undertake every related step. Check the proposed document before signing it abroad.

This guide concerns preparing and using authority for a property transaction. It does not address whether a past sale should be cancelled for forgery or misuse of authority; those are separate disputes. The main practical aim is to avoid an overseas signing that must be repeated because the document is unsuitable for the Turkish procedure.

Start with the act the representative must perform

“Deal with my property” can describe several distinct tasks. A representative may need to obtain records, sign a sale, purchase a specified unit, deal with a mortgage, receive a price, manage a lease or conduct litigation. Authority suitable for one task should not be presumed sufficient for all of them.

TKGM’s guidance makes the requested transaction’s authority a condition of representation. Prepare a task list before preparing the document. Identify the property where appropriate, the people involved, the intended transaction and any restrictions on the representative. The wording should be checked against what the receiving land registry, bank, notary or court will require.

The choice of scope is also a risk-management decision. Consider whether price receipt, sale to particular persons, delegation to another representative or the creation of a mortgage is intended. Broad language copied from an unrelated transaction can grant powers the owner did not mean to give. Conversely, a restriction that is unclear to the receiving authority can prevent the intended act.

Choose the appropriate overseas route

One route is an instrument prepared through a Turkish consular authority where the service is available for the applicant and transaction. Another is an instrument issued by a competent foreign authority and authenticated for use in Turkey. These routes have different practical requirements. Check the consulate’s appointment and document instructions rather than assuming every person can use the same service.

For relevant foreign public documents within the Hague Apostille Convention framework, authentication normally involves an apostille from the competent authority. For other documents, the applicable chain can include authentication by a superior local authority and the Turkish consular authority in that country. TKGM identifies country-specific exceptions, so “the country uses apostilles” is only the beginning of the check.

Authentication concerns the public document’s official origin. It does not replace examination of the powers granted, the principal’s identity or the requirements for the proposed Turkish transaction. A correctly authenticated document can still be unsuitable if its operative wording authorises a different act.

Photographs, page links and the instrument’s language

The TKGM guidance for foreign property powers of attorney requires a photograph and describes how the issuing authority should authenticate it. It also addresses the issuing country’s language, seals and links between pages. A loose photograph added later is not a safe solution to a missing formal requirement.

Where an apostille appears on a separate sheet, the connection to the underlying power of attorney must be clear. Retain all pages, attachments and certification sheets together. Do not send only the signature page or the apostille for review: the authority, identity details and attached property description may appear elsewhere.

The authority that issues the document and the authority competent to authenticate it should be identified in advance. Requirements may differ between regions within a country and between types of issuing authority. The relevant official instructions, rather than the nationality suggested by the document’s language, should guide the process.

Arrange the Turkish translation for the receiving procedure

TKGM’s foreign acquisition FAQ requires the original or a certified copy of a foreign power of attorney together with its translation. The official property transaction guide also describes a notarised Turkish translation. The translation must cover the operative text and relevant certifications so that the Turkish authority can assess the complete instrument.

Check names, passport details, dates and property identifiers carefully. Differences in transliteration may need explanation even where two spellings refer to the same person. A translation should preserve limits and conditions: “may sell” and “may obtain information about a proposed sale” are not equivalent.

A scanned draft is useful for an initial review, but it should not be treated as proof that the original will be accepted. Nor should a general electronic signature or emailed copy be assumed equivalent to the document required by the receiving office. Confirm the accepted submission method for the particular procedure.

Coordinate authority with payment and registration

Even where the representative may sign the transfer, decide who will receive the purchase price and how the payment will be evidenced. A bank may apply its own identification and representation checks. Resolve these matters before arranging a signing date, especially if the owner and buyer are in different countries.

If a mortgage must be released or an existing tenant affects possession, the authority and transaction plan should address those steps separately. Granting a power of attorney does not clear encumbrances, change the property’s legal status or establish a buyer’s eligibility to acquire it.

What should be supplied for an initial review?

  • A description of the proposed act and the expected receiving authority.
  • The draft power of attorney and every attachment.
  • The issuing country and intended issuing and authentication authorities.
  • The relevant property details and the parties’ names as recorded in the transaction documents.
  • Any restrictions on price, payment, delegation or the duration of authority.
  • The planned signing, translation, delivery and registration dates.

Identity documents may be required later through an appropriate private channel. They do not need to be included in an initial website message. A clear task description is more useful at that stage than sending unrelated personal records.

Practical assessment

The most efficient sequence is to settle the transaction plan, check the draft with the Turkish procedure in mind, confirm the overseas formalities, execute the instrument, and then verify the completed original and translation. Each step answers a different question. Completing them in that order reduces the chance of having an expensive but unusable document.

If the plan changes or authority is withdrawn, the consequences and notification steps should be assessed before anyone acts. Keeping an old document in a drawer is not a substitute for addressing the authority already communicated to other parties. For an initial review of a proposed property power of attorney, describe the intended transaction through the contact page.
